TERMS & CONDITIONS

“Beach House Raffle” Terms and Conditions

For the purposes of these terms and conditions, “GMC” may be used to refer to “Gateway Men’s Chorus”; “Beach House” may be used to refer to the building, grounds, or furnishings within or surrounding the building located at 1389 W. Beach Blvd., Gulf Shores, Alabama 36542; “Beach House Owner” may be used to refer to Bill Bailey or Waters Edge Property Management, LLC; and, “Participant” may be used to refer to anyone who participates in the raffle by purchasing a ticket from GMC or its affiliates.

By purchasing a ticket to participate in the raffle, you (“Participant”) agree to be bound by these terms and conditions:

  • All raffle ticket sales are final, non-refundable, and non-transferable.  
  • Participant understands that for this raffle, two-hundred (200) tickets will be sold at fifty dollars apiece ($50.00), and only one (1) winner will be randomly selected.
  • Participant understands that there is no limit on the amount of individual tickets that participant may purchase, but Participant will be unable to purchase any more tickets once two hundred (200) overall tickets have been sold.
  • Participant understands that the winner of this raffle will be selected and announced by GMC at the final GMC December Concert, which will take place on or about December 15, 2024. 
  • Participant understands that if their ticket is randomly selected as the winner, and Participant is not present at the final GMC December Concert, Participant will be notified shortly thereafter by a GMC representative via telephone call, text message, or email.
  • Participant understands that it is their responsibility to provide GMC a reliable telephone number and email address at the time of the purchase of their raffle ticket.  Furthermore, Participant understands that they have an ongoing responsibility to notify GMC if the telephone number or email address they provided to GMC changes prior to the final December GMC Concert.
  • Participant understands that if they are randomly selected as the winner of the raffle and they have not provided a reliable or up to date telephone number and/or email address to GMC prior to the final December GMC Concert, GMC reserves the right to select a new winner five (5) business days after GMC has attempted to contact Participant.
  • Participant understands that if their ticket is randomly selected as the winner, GMC may announce their name on GMC’s social media accounts and website.

FURTHERMORE, by purchasing a raffle ticket, Participant understands that if their ticket is selected as the winning ticket, the following conditions and limitations apply:

  • If Participant is randomly selected as the winner of the raffle, they will be provided the Beach House Owner’s name and contact information.  It is Participant’s sole responsibility to contact the Beach House Owner to coordinate usage of the beach house.  Furthermore, Participant understands that they have until December 31, 2025, to contact the Beach House Owner.
  • Participant understands that the maximum number of people who may stay at the Beach House at any given time is fourteen (14) individuals, including Participant.
  • Participant understands that their usage of the beach house is subject to availability.  Participant also understands that GMC cannot guarantee that the Beach House will be available for usage on any specific dates or times.  Only the Beach House Owner can guarantee the Beach House’s availability for specific dates and times.
  • Participant understands that the Beach House will be unavailable from May 20, 2025, through September 3, 2025.
  • Participant understands that they will be solely responsible for paying a $500.00 security deposit at the time they stay at the Beach House.  The $500.00 security deposit will be returned by the Beach House owner to Participant at the end of their stay, provided that the Beach House is left in its original or substantially similar condition.
  • Participant understands that if their ticket is randomly selected as the winner, they are solely responsible for their travel to and from the Beach House. The prize only includes the Beach House rental.
  • Participant understands that Participant alone is responsible and liable to Beach House Owner for any damages that occur to the Beach House as a result of Participant’s usage of the Beach House.  Furthermore, Participant understands that Participant is solely responsible for any damages that are caused by any person Participant invites to the Beach House.​
 
  • By purchasing a raffle ticket, Participant agrees that if Participant is randomly selected to be the winner, Participant does hereby hold harmless, release, waive, discharge, and covenant not to sue Gateway Men’s Chorus and all its subsidiaries, affiliates, board members, shareholders, employees, agents, or members from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant, or Participant’s Guests, or any of the property belonging to Participant or Participant’s Guests, while Participant or Participant’s guests are traveling to, traveling from, or staying at the Beach House.
 
  • By purchasing a raffle ticket, Participant agrees that if Participant is randomly selected to be the winner, should any type or kind of lawsuit or legal action be brought against Gateway Men’s Chorus (including against any of GMC’s employees, agents, board members, members, or affiliates) related to Participant’s or Participant’s Guest’s usage of the Beach House, in addition to holding Gateway Men’s Chorus harmless, Participant agrees to indemnify and provide a defense for Gateway Men’s Chorus, with Gateway Men’s Chorus having the right to participate in the choice of counsel.  Furthermore, Participant agrees to pay for all costs of that defense, including but not limited to attorneys’ fees, court costs, and investigation costs.
  • By purchasing a raffle ticket, Participant acknowledges that these Terms & Conditions are in addition to any Terms & Conditions set in place by the Beach House Owner for the usage of the Beach House --  including, but not limited to, cancellation policies, deposit refund policy,  force majeure policies, or any similar or related policies. Prior to reserving the Beach House, Participant is responsible for viewing and abiding by any additional Terms & Conditions set forth by the Beach House.
